Welcome to Pixie World! These Terms and Conditions ("Terms") govern your access to and use of the Pixie World mobile application ("App"), including any content, functionality, and services offered on or through the App.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

Important: If you are under 18 years of age, you must have your parent or legal guardian read and agree to these Terms before using the App.

The App is intended for use by children under the supervision of their parents or legal guardians. By creating an account:

• You confirm that you are at least 18 years old or have obtained parental consent
• You agree to provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

Pixie World provides:

• AI-generated personalized stories tailored to your child's age, interests, and personality
• A library of professionally written stories for children
• Audio narration of stories for listening
• Educational content and learning objectives customizable by parents
• Various story styles and themes to choose from

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

7. Prohibited Uses

You agree not to use the App to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, post, or transmit any harmful, threatening, abusive, or offensive content
• Impersonate any person or entity or falsely represent your affiliation
• Interfere with or disrupt the App's servers or networks
• Attempt to gain unauthorized access to any part of the App or other users' accounts
• Use automated systems (bots, scrapers) to access the App without permission
• Collect personal information about other users without consent
• Transmit viruses, malware, or any code that could harm the App or its users

8. Content Guidelines

All content generated and accessed through Pixie World must be appropriate for children. We use AI and human moderation to ensure content safety, but we cannot guarantee that all content will be appropriate at all times.

Parents and guardians are responsible for monitoring their child's use of the App. If you encounter inappropriate content, please report it to us immediately at report@pixieworld.com

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

To the fullest extent permitted by law, Pixie World, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the App.

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Pixie World and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or generate through the App

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Australia, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in the Commonwealth of Australia for any disputes.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Sending an email notification
• Displaying an in-app notification

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and cancel your subscription.

17. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• At your request

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely reflects the original intent.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pixie World regarding the use of the App and supersede all prior agreements and understandings.
